Terms and Conditions
1. General Terms
1.1 These Terms of Trading govern the relationship between H & W Signature Journeys Ltd. (“H & W”/ “We”/ “Us”/ “Our”) and the Guest (“You”), covering the provision of luxury travel services, accommodations, tours, and activities. By booking with H & W, the Guest agrees to be bound by these Terms of Trading.
1.2 Acceptance of these terms, whether by electronic mail or other means, shall be deemed as agreement to the terms of the contract.
2. Booking and Payment Terms
2.1 Booking Deposit: A non-refundable deposit of 30% of the total booking value is required to confirm any reservation. This deposit secures accommodations, tours, and any agreed-upon services.
2.2 Final Payment: The balance of payment is due no later than 30 days prior to the travel date. Should payment not be received by this date, H & W reserves the right to cancel the reservation without further notice, subject to cancellation terms herein.
3. Cancellations and Refunds
3.1 Non-Refundable Deposit: The initial 30% deposit is strictly non-refundable under all circumstances.
3.2 Final Payments: Cancellations within 30 days of the travel date are subject to a no-refund policy. No refunds will be given for cancellations after this period or for any unused services during travel.
4. Special Activity Bookings
4.1 Gorilla Tracking: Gorilla tracking is available by request only and is subject to additional fees and permit availability. H & W makes no guarantees regarding permit availability at the time of booking.
5. Force Majeure
5.1 H & W shall not be liable for failure to perform or fulfill its obligations due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, war, civil unrest, strikes, government restrictions, or any other Force Majeure event. In such cases, H & W reserves the right to amend or cancel the affected bookings, with reasonable efforts to re-accommodate the Guest.
5.2 In the event of Force Majeure, H & W may refund the Guest at its sole discretion, excluding non-refundable deposits and any additional costs incurred.
6. Guest Conduct and Removal Policy
6.1 Conduct Expectations: H & W expects respectful conduct from all Guests to maintain the enjoyment of the group. Should a Guest engage in disruptive or inappropriate behavior, H & W reserves the right to remove the Guest from the tour without refund or compensation.
6.2 Liability for Costs: Any additional costs arising from such removal shall be the responsibility of the Guest.
7. Limitation of Liability
7.1 H & W subcontracts air, road, and water travel services to independent providers. H & W is not liable for delays, cancellations, or inaccuracies in flight schedules or other transportation services.
7.2 Loss of Personal Property: The safekeeping of all baggage and personal effects remains at the Guest's risk. H & W assumes no liability for lost or damaged baggage.
8. Travel Insurance
8.1 Mandatory Insurance: The Guest is responsible for procuring travel insurance covering medical expenses, evacuation, cancellations, and curtailment. H & W strongly recommends comprehensive insurance for all travelers.
8.2 Medical Emergencies: H & W has procured emergency support services to facilitate medical evacuations. Any associated costs may be recovered from the Guest’s travel insurance provider.
9. Governing Law and Jurisdiction
9.1 These Terms of Trading are governed by and construed in accordance with the relevant international laws governing travel and tourism. Disputes shall be subject to the jurisdiction of the courts within H & W’s operating jurisdiction, except as may be modified by mutual agreement.
10. Notices and Addresses
10.1 Notices and other communications may be delivered electronically to the addresses provided by H & W and the Guest. Physical notices will be sent to the primary business addresses as provided in the booking confirmation.
By engaging in a booking with H & W Signature Journeys Ltd., the Guest acknowledges and agrees to these Terms of Trading.
